Secretary of state files motion to dismiss voter ID lawsuit

BISMARCK, N.D. (AP) – Secretary of State Al Jaeger has asked a federal court to dismiss a lawsuit that alleges the state’s voter identification requirements are unconstitutional.

KXMB-TV reports Attorney General Wayne Stenehjem filed the motion to dismiss Wednesday.

Seven members of the Turtle Mountain Band of Chippewa last month sued North Dakota’s chief elections officer. The lawsuit alleges North Dakota’s voter ID requirements “disproportionately burden and disenfranchise Native Americans.”

The motion to dismiss says the North Dakota law is constitutional.

North Dakota is the only state without voter registration. State law requires identification such as a driver’s license, or identity cards issued by North Dakota’s American Indian tribes.
