FLAGSTAFF, Ariz. (AP) – The Hopi Tribe says it’s challenging a ruling in a case that seeks to keep treated wastewater from being turned into snow.

The city of Flagstaff is under contract to sell reclaimed wastewater to the Arizona Snowbowl for artificial snow.

The tribe contends the wastewater would harm human health and the environment.

A Coconino County Superior Court judge ruled last month that the substantial components of the case already had been decided in federal court, where a number of tribes challenged the snowmaking plan but lost. The judge says the Hopi Tribe legally was required to raise its objections earlier.

The tribe says its public nuisance claims have not been addressed and cannot be barred by the previous case. It gave notice of an appeal last week.
