DRUG TAKE BACK DAY


The U.S. Attorneys in both North and South Dakota are encouraging participation in the Drug Enforcement Administration’s (DEA) National Drug Take-Back Day on Saturday, Sept. 29 2012, from 10:00am-2:00pm, local time. The goal of this nationwide initiative is to allow people to safely dispose of their unused, expired, and unwanted prescription pills at specified drop off sites. Drop off sites will be located at each of the four North Dakota reservations, as well as all of the South Dakota reservations. In an effort to decrease the chances of prescription medication abuse in tribal communities, this event is free and anonymous. Justice Department Awards $101 Million to Enhance, Support Tribal Justice and Safety

The Department of Justice announced more than 200 grants to more than 110 American Indian and Alaska Native Nations on Sept. 27, 2012. The grants will provide more than $101 million to enhance law enforcement practices, and sustain crime prevention and intervention efforts in 10 purpose areas including public safety and community policing; justice systems planning; alcohol and substance abuse; corrections and correctional alternatives; violence against women; elder abuse; juvenile justice; and tribal youth programs.

ILLEGAL GAMBLING


81-Count Indictment Unsealed Charging Ten Defendants Engaged in Illegal Gambling Operation (U.S. Attorney for the Western District of Oklahoma)

On Sept. 24, 2012, the U.S. Attorney Sanford C. Coats announced that an 81-count federal indictment was unsealed, charging 10 defendants with crimes involving illegal gambling and money laundering. According to the indictment, the defendants operated “High Stakes” poker games, took bets and wagers on sporting events, used an illegal Internet gambling website, laundered the proceeds of illegal gambling activities, and committed a variety of crimes related to the illegal gambling operation. It is alleged that some of the defendants conspired to launder over $8.1 million in money derived from the gambling operation. If convicted, five of the 10 defendants could each face up to 20 years in prisons and a $500,000 fine.

Former Pawnee Nation Official Sentenced to Probation for Embezzlement (U.S. Attorney for the Northern District of Oklahoma)

U.S. Attorney Clinton Johnson announced that Frances L. Roughface, 47, was sentenced on Sept. 26, 2012, to three years of probation after she pleaded guilty to a federal theft charge. Roughface has been ordered to serve the first six months of probation under house arrest, and to pay $36,226 in restitution. Roughface pleaded guilty in federal court in June, admitting that she embezzled money from the tribe's Child Care Center and the Pawnee Nation's Indian Child Welfare program. Roughface led the tribe to believe that she spent tribal funds on Walmart gift cards for the benefit of families and children in crisis, when actually she used the funds on personal items for herself.


Crownpoint, N.M., Woman Sentenced To Probation For Embezzling Money From An Indian Tribal Organization (U.S. Attorney for the District of New Mexico)

U.S. Attorney Kenneth J. Gonzales announced that on Sept. 10, 2012, in federal court in Santa Fe, N.M., Shavna April Bebo, 36, of Crownpoint, N.M., was sentenced to a three-year term of probation for embezzling from an Indian tribal organization.  Bebo also was ordered to pay restitution in the amount of $38,998.37 to the victim of her criminal conduct.  Bebo was charged on Jan. 26, 2012, in an indictment alleging that, from Oct. 2009 through Aug. 2010, Bebo willfully and knowingly embezzled $38,998.37 of the funds belonging to the Littlewater Chapter House, a tribal organization in Crownpoint.  On June 5, 2012, Bebo pleaded guilty to the indictment under a plea agreement with the U.S. Attorney's Office.


FALSE REPRESENTATION


California Man Charged with Falsely Claiming that his Jewelry was Produced by an Indian (U.S. Attorney for the District of New Mexico)

U.S. Attorney Kenneth J. Gonzales announced that Andrew Gene Alvarez, 59, has been indicted on a charge of falsely representing that jewelry he offered for sale was made by an Indian. According to the indictment, in May 2011, Alvarez offered for sale and sold jewelry at the Native Treasures Show at the Santa Fe Community Convention Center, and falsely represented that the jewelry was produced by an Indian. If convicted, Alvarez faces up to five years of imprisonment and a $250,000 fine.


ARSON


Belcourt Man Sentenced for Arson (U.S. Attorney for the District of North Dakota)

U.S. Attorney Timothy Q. Purdon announced that on Sept. 21, 2012, Joseph J. Morin, 37, of Belcourt, N.D., was sentenced in federal court on a charge of arson. Morin pleaded guilty to the charge on June 18, 2012. The judge sentenced Morin to three years and ten months in federal prison, to be followed by two years of supervised release. Morin was ordered to pay a $100 special assessment to the Crime Victim’s Fund. On Feb. 5, 2012, Morin went to a residence in the Belcourt area, where he removed all of the electrical meters, set fire to paper, and threw the burning paper into a dryer vent Morin accessed from the outside. Morin then stuffed a towel into the dryer vent, causing a fire on the inside of the house.


WITNESS RETALIATION


Eagle Butte Man Sentenced for Witness Retaliation (U.S. Attorney for the District of South Dakota)

U.S. Attorney Brendan V. Johnson announced that an Eagle Butte, SD man charged with Retaliating Against a Witness was sentenced on Sept. 24, 2012. Allan Kermit Chasing Hawk, 48, was sentenced to 12 months and one day in custody, one day of supervised release, and a $100 special assessment to the Victim Assistance Fund. Chasing Hawk’s conviction stems from an incident that occurred on October 21, 2011, when Chasing Hawk called the victim and threatened her for providing truthful information to law enforcement which led to the conviction of Jerry Chasing Hawk in federal court.


DRUG ENFORCEMENT


Crystal Gretchen Nomee Pleads Guilty in U.S. Federal Court (U.S. Attorney for the District of Montana)

U.S. Attorney Michael W. Cotter announced that on Sept, 24, 2012. Crystal Gretchen Nomee, 34, plead guilty to conspiracy to possess with the intent to distribute methamphetamine. During the investigation, law enforcement learned that Nomee purchased methamphetamine for resale to customers in the area, as well as for her own person use from approximately 2010 through October 2011. Sentencing has been set for Jan. 3, 2013


Mobridge Man Sentenced to 151 Months for Meth Conspiracy   (U.S. Attorney for the District of South Dakota)

U.S. Attorney Brendan V. Johnson announced that a Mobridge, S.D., man charged with Conspiracy to Distribute and Possess with Intent to Distribute a Controlled Substance by a federal grand jury was sentenced on Sep. 17, 2012, to 151 months in custody, 3 years of supervised release, and $100 special assessment to the Victim Assistance Fund.

Browning Woman Pleads Guilty to Involuntary Manslaughter in Prescription Drug Overdose (U.S. Attorney for the District of Montana)

U.S. Attorney Michael W. Cotter announced that during a federal court session in Great Falls, on Sept. 12, 2012,   Verla Ann Still Smoking, a 41-year-old resident of Browning and an enrolled member of the Blackfeet Tribe, pled guilty to involuntary manslaughter and making false statements related to the victim’s lethal overdose of prescription medication at Still Smoking’s residence in March 2011.  Sentencing has been set for January 7, 2013.

St. Francis Man Sentenced for Sexual Abuse of a Minor (U.S. Attorney for the District of South Dakota)

U.S. Attorney Brendan V. Johnson announced that Ennors Abraham Quick Bear, 24, was sentenced on Sept. 26, 2012. Quick Bear was charged with Sexual Abuse of a Minor, and was sentenced to 12 months and 1 day in prison, five years of supervised release, and a $100 special assessment to the Victim Assistance Fund. The conviction stems from an event occurring between Jan. 2009 and Oct. 2010, when Quick Bear engaged in a sexual act with a 14-year-old minor.

Mescalero Apache Man Sentenced to Three Years in Prison for Abusive Sexual Contact Conviction. (U.S. Attorney for the District of New Mexico)

U.S. Attorney Kenneth J. Gonzales announced on Sept. 27, 2012 that Riley Maurice Chino, 60, was sentenced to a three-year term of imprisonment for his abusive sexual contact conviction. Chino will be on supervised release for a year after he completes his prison sentence, and he will also be required to register as a sex offender.

Belcourt Man Pleads Guilty to Assault Charges (U.S. Attorney for the District of North Dakota)

U.S. Attorney Timothy Q. Purdon announced that on Sept. 25, 2012, Felix E. Wallette Jr., 40, pleaded guilty to an assault by striking, beating, or wounding, and a charge of domestic assault by a habitual offender. Charges stem from an event that occurred on Sept. 11, 2011, when Wallace assaulted the victim in his vehicle. Wallace has previously been convicted in North Dakota state court proceedings and in Turtle Mountain Tribal Court of at least two other domestic violence offenses.

Mohave County Man Indicted on Charges of First Degree Murder and Child abuse on Fort Mojave Indian Reservation (U.S. Attorney for the District of Arizona)

U.S. Attorney John S. Leonardo announced on Sept. 21, that Matthew Lee Smith, 30, had his initial appearance in federal district court in Phoenix. In August, Smith was indicted for two counts of first degree murder, two counts of child abuse, one count of assault with intent to commit murder, two counts of assault with intent to commit child abuse, and four counts of assault resulting in serious bodily injury. Smith is being detained pending trial in Prescott, Ariz., on Nov. 6, 2012.

Wanblee Man Sentenced in Kidnapping Case (U.S. Attorney for the District of South Dakota)

U.S. Attorney Brendan V. Johnson announced that a Wanblee, SD man charged with Kidnapping and Aiding and Abetting was sentenced on Sept. 24, 2012 in federal court. William Jakeway, 52, was sentenced to 108 months in custody, three years of supervised release, and a $100 special assessment to the Victim Assistance Fund. The conviction regards an incident that took place on Nov. 5, 2011, when Jakeway and his son abducted the victim, believing the victim had stolen a piece of property from another family member. At gun point, they assaulted the victim, and left him on the Rosebud Sioux Indian Reservation. Law enforcement agencies located the Jakeways while they were driving, and freed the victim, who suffered bruises and abrasions. Jakeway’s son and co-defendant pleaedd guilty to kidnapping and aiding and abetting, and will be sentenced on Oct. 1, 2012.

Federal Jury Convicts Ramah Navajo Man of Voluntary Manslaughter (U.S. Attorney for the District of New Mexico)

U.S. Attorney Kenneth J. Gonzales announced that Dhanzasikam R. Toledo, 21, was convicted of voluntary manslaughter on Sept. 26, 2012. Toledo was arrested on Nov. 21, 2011 on a criminal complaint that he murdered his uncle. Evidence established that a simple argument between Toledo and his uncle escalated quickly, and Toledo stabbed his uncle after racially derogatory slurs about Toledo were said. At sentencing, Toledo faces a maximum penalty of fifteen years in prison.


Belcourt Man Pleads Guilty to Involuntary Manslaughter (U.S. Attorney for the District of North Dakota)

U.S. Attorney Timothy Q. Purdon announced that on Sept. 24, 2012, Koleman J. Gourneau, 30, pleaded guilty to involuntary manslaughter. In an incident occurring on Oct. 12, 2011, Gourneau left a bar intoxicated, and began to drive his Ford Bronco. While driving, Gourneau’s vehicle struck a person, causing significant injuries which resulted in her death. The charge of involuntary manslaughter carries a statutory maximum penalty of eight years in federal prison and a $250,000 fine.

Navajo Man from Two Grey Hills, N.M., Pleads Guilty to Federal Assault Charge (U.S. Attorney for the District of New Mexico)

U.S. Attorney Kenneth J. Gonzales announced that Travis Cohoe plead guilty to a federal assault charge on Sept. 24, 2012. Under the terms of his pleas agreement, Cohoe, 43, was sentenced to a prison term of a year and a day. Cohoe was originally charged with assault with a dangerous weapon, and assault resulting in a serious bodily injury regarding an incident that occurred on April 13, 2010. In that incident, Cohoe ran over the victim with is vehicle, resulting in serious bodily injuries. Cohoe also admitted that he was intoxicated at the time.

Cannon Ball Man Sentenced for Assault on a Federal Officer (U.S. Attorney for the District of North Dakota)

U.S. Attorney Timothy Q. Purdon announced that Bruce Flying Horse, 23, of Cannon Ball, S.D., was sentenced on Sept. 24, 2012, on a charge of assaulting a federal officer. Flying Horse was sentenced to seven months in prison, followed by a six-month placement in a half-way house. Additionally, Flying Horse will be on supervised release for two years, and must pay a $100 special assessment to the Crime Victim’s Fund. On Feb. 21, 2012, law enforcement officers responded to a disturbance call from a Cannon Ball residence. Upon arrival, the occupants of the residence had already detained Flying Horse. While attempting to arrest Flying Horse, he began to strike the officers, and struck a federal officer. He pleaded guilty to the charge on June 22, 2012.

Tonkawa Man to Serve Six Years in Prison for Arson, Burglary, and Theft on Indian Land (U.S. Attorney for the Western District of Oklahoma)

The U.S. Attorney Sanford C. Coats announced that Kyle, Lynn Enloe, 20, from Tonkawa was sentenced on Sept. 20 to serve 72 months in federal prison for arson, second degree burglary, and theft of personal property. Enloe is also ordered to serve five years of supervised release and pay $181,906.56 in restitution. During an event occurring on July 5, 2010, Enloe brooke into an apartment, stole personal property, and set fire to the owner’s motorcycle outside, which spread and burned the duplex down.

Great Falls Man Sentenced to 33 Months in Prison for Assault with a Deadly Weapon (U.S. Attorney for the District of Montana)

The U.S. Attorney’s Office announced Ivan Dean Ingraham, 21, was sentenced to 33 months in prison on Sept. 20, 2012. Along with his prison sentence, the Browning, MT resident was sentenced to three years of a supervised release, as well as a $100 special assessment. Ingraham’s sentence follows his guilty plea to assault with a dangerous weapon. Ingraham pleaded guilty to an incident in which he and an accomplice kicked in the door of M.H.’s residence, entered the living room, and lunged at M.H. with a knife. The incident occurred on Dec. 11, 2010.


Zuni Pueblo Man Pleads Guilty To Federal Assault Charge (U.S. Attorney for the District of New Mexico)

U.S. Attorney Kenneth J. Gonzales announced that Aaron Yatsattie, 30, a member and resident of Zuni Pueblo, plead guilty on Sept. 19, 2012 to a one count indictment charging him with assault resulting in serious bodily injury. In his plea agreement, Yatsattie admitted that on April 29, 2012, he seriously injured an 18-year-old Zuni Pueblo man by running over him with a sport utility vehicle at a high rate of speed.  Yatsattie further admitted that he was intoxicated at the time. Court records reflect that the victim sustained multiple fractures to both his legs and bruised lungs.  Under the terms of his plea agreement, Yatsattie will be sentenced to 27 months in prison and a term of supervised release to be determined by the court.  Yatsattie has been in custody since his arrest on May 15, 2012, and remains detained pending his sentencing hearing, which has yet to be scheduled.

Shiprock, N.M., Man Pleads Guilty To Federal Child Sex Abuse Charges (U.S. Attorney for the District of New Mexico)

U.S. Attorney Kenneth J. Gonzales announced that on Sep. 17, 2012 in Albuquerque federal court, Delbert Begaye, 56, a member of the Navajo Nation who resides in Shiprock, N.M., pled guilty to an information charging him with two counts of aggravated sexual abuse of a child under the age of 12. Under the terms of his plea agreement, Begaye will be sentenced to 10 years in prison to be followed by not more than five years of supervised release.  Begaye also will be required to register as a sex offender.  Begaye is detained pending his sentencing hearing, which has yet to be scheduled.

Wakpala Man Sentenced in Sexual Assault Case (U.S. Attorney for the District of South Dakota)

U.S. Attorney Brendan V. Johnson announced that a Wakpala, South Dakota, man charged with Sexual Abuse with a Person Incapable of Consenting was sentenced on September 17, 2012, by United States District Judge Charles B. Kornmann. Lyle Baker, age 53, was sentenced to 135 months in custody, 5 years of supervised release, and a $100 special assessment to the Victim Assistance Fund. Baker was indicted by a federal grand jury on October 12, 2011, and pled guilty to the charge on June 20, 2012. The conviction stems from an incident that took place in May 2011 when Baker sexually assaulted a young woman in Wakpala, South Dakota.

Tohono O’Odham Woman Sentenced to 42 Months in Federal Prison for Causing Head-On Collision While Intoxicated (U.S. Attorney for the District of Arizona)

U.S. Attorney John S. Leonardo announced that on Sept. 13, 2012, Shea Nunez, 36, was sentenced to 42 months in federal prison. On July 5, 2012, Nunez pleaded guilty to vehicular assault causing serious bodily injury, and child abuse. On Jan. 30, 2010, Nunez was driving northbound when she crossed the center line and collided head-on with a vehicle in the southbound lane. Three occupants in the other vehicle sustained serious bodily injuries, as did a four-year-old child in Nunez’s vehicle, who was unrestrained at the time of the crash. Following the crash, Nunez had a blood alcohol level of .306, nearly four times the legal limit.

Non-Native Resident of Pojoaque Pueblo Arrested on Child Pornography Charges (U.S. Attorney for the District of New Mexico)

U.S. Attorney Kenneth J. Gonzales announced that on Sep. 12, 2012 the FBI arrested Johncarlos Ortiz, 39, on a criminal complaint alleging child pornography charges.  Ortiz, a resident but not a member of Pojoaque Pueblo, N.M., made his initial appearance in federal court in Albuquerque this morning.  Ortiz entered a not guilty plea in federal court on Sep. 13, 2012 and waived his right to a preliminary hearing.  He was ordered detained pending trial.  The complaint alleges that Ortiz possessed and distributed child pornography on Sept. 11, 2012, at his residence in Pojoaque Pueblo.   According to the complaint, the investigation of the case was initiated in July 2012, after the National Center for Missing and Exploited Children (NCMEC) received information that images consistent with child pornography had been posted on a social networking website.  If convicted of the distribution offense, Ortiz faces not less than five years and not more than 20 years in prison. If convicted of the possession offense, Ortiz faces a maximum ten year prison sentence.

Mission Man Pleads Guilty to Aggravated Sexual Abuse (U.S. Attorney for the District of South Dakota)

U.S. Attorney Brendan V. Johnson announced that Justin Beardt, 30, of Mission, S.D., appeared in federal court on Sept. 12, 2012, and pled guilty to Aggravated Sexual Abuse.  The maximum penalty upon conviction is life in custody, a $250,000 fine, or both. The conviction stems from an incident that took place on Jan. 23, 2011, when Beardt sexually abused the victim by force.


Mission Man Sentenced for Second Degree Murder (U.S. Attorney for the District of South Dakota)

U.S. Attorney Brendan V. Johnson announced that a Mission, South Dakota, man charged with Second Degree Murder was sentenced on Sept. 12, 2012, by United States District Judge Roberto A. Lange.  Lawrence Anthony Whipple, 54, was sentenced to 192 months in custody, 3 years of supervised release, and a $100 special assessment to the Victim Assistance Fund. Whipple was indicted by a federal grand jury on February 14, 2012, and pled guilty to the charge on June 20, 2012. The conviction stems from an incident that took place on February 7, 2012, when Whipple stabbed the victim with a knife.  The victim died as a result of her injuries.


Lower Brule Man Sentenced on Sexual Abuse Charge (U.S. Attorney for the District of South Dakota)

U.S. Attorney Brendan V. Johnson announced that a Lower Brule man charged with Sexual Abuse of a Minor was sentenced on Sept. 11, 2012, by U.S. District Judge Roberto A. Lange.  Sean Johnson, 22, was sentenced to 15 months in custody, five years of supervised release, and a $100 special assessment.  Johnson was indicted by a federal grand jury in April 2012 on three counts of Sexual Abuse of a Minor.  He pled guilty to one count in June 2012.  The conviction stems from the time frame of December 2011 to February 2012, when Johnson and the minor victim met and began communicating via text messages.  In February 2012, Johnson admitted to having sex with the minor victim three separate times.


Lodge Grass Man Sentenced to more than 19 Years in Prison for Aggravated Sexual Abuse (U.S. Attorney for the District of Montana)

U.S. Attorney Michael W. Cotter announced that during a federal court session in Billings, on Sept. 12, 2012, Perry Nation, a 50-year-old resident of Lodge Grass and an enrolled member on the Fort Peck Indian Reservation, appeared for sentencing.  Nation was sentenced to 235 months in prison, and lifetime supervision after release for his conviction for raping an 11 year old girl and molesting a 7-year-old boy.


Beclabito, N.M., Man Charged With Causing The Death Of A Minor By Serving Her Liquor (U.S. Attorney for the District of New Mexico)

U.S. Attorney Kenneth J. Gonzales announced on Sept. 12, 2012 that Stanford Benally, 41, a member of the Navajo Nation who resides in Beclabito, N.M., made his initial appearance in Albuquerque federal court on a two-count indictment charging him with second degree murder, and  involuntary manslaughter.  Benally, who was arrested yesterday by the FBI, remains in custody pending a detention hearing and arraignment on Sept. 13, 2012. Count 1 of the indictment, the second degree murder charge, alleges that, on May 19, 2012,  Benally caused the death of a minor female by serving her liquor, and failing to provide care and seek medical attention for the minor in a manner that evinced a callous and wanton disregard for human life.     If convicted of the murder charge, Benally faces a maximum penalty of life imprisonment.


Rock Spring, N.M., Man Sentenced To Prison For Child Sexual Abuse  (U.S. Attorney for the District of New Mexico)

U.S. Attorney Kenneth J. Gonzales announced that on Sept. 11, 2012, a federal judge in Albuquerque sentenced Karl Domingo, 37, an enrolled member of the Navajo Nation who resides in Rock Spring, N.M., to a 24-month prison term for his abusive sexual contact conviction.  Domingo will be on supervised release for seven years after he completes his prison sentence.  He also will be required to register as a sex offender.  Domingo pled guilty to an information charging him with sexually assaulting a 10-year-old female on the Navajo Indian Reservation.         


Fort Belknap Man Pleads Guilty to Sexual Abuse of a Minor (U.S. Attorney for the District of Montana)

U.S. Attorney Michael W. Cotter announced that during a federal court session in Great Falls, on Sept. 11, 2012, Gregory Rider, a 47-year-old resident of Harlem, Mont., and an enrolled member of the Fort Belknap Indian Reservation, pled guilty to sexual abuse of a minor.  Sentencing has been set for December 17, 2012.  He is currently detained. In an Offer of Proof, the government stated it would have proved at trial the following: Between approximately July 1, 2005, and approximately July 1, 2007, Rider sexually abused a minor at his home located on the Fort Belknap Indian Reservation. Rider faces possible penalties of 15 years in prison, a $250,000 fine and lifetime supervision.


Little Eagle Man Sentenced to 108 Months for Sexual Abuse (U.S. Attorney for the District of South Dakota)

U.S. Attorney Brendan V. Johnson announced that a Little Eagle, S.D., man charged with Sexual Abuse with a Person Incapable of Consenting was sentenced in federal court on Sept. 10, 2012. Grady Laine Uses Arrow, 21, was sentenced to 108 months in custody, 5 years of supervised release, and a $100 special assessment to the Victim Assistance Fund. Uses Arrow was indicted by a federal grand jury on March 13, 2012, and pled guilty to Sexual Abuse with a Person Incapable of Consenting on June 4, 2012. The conviction stems from an incident in October 2010 when Uses Arrow sexually assaulted another person at Little Eagle.


Never Misses A Shot Sentenced for Making False Statements (U.S. Attorney for the District of South Dakota)

U.S. Attorney Brendan V. Johnson announced that a Sioux Falls man charged with False Statement was sentenced on Sept. 10, 2012, by U.S. District Judge Charles B. Kornmann.  Michael Todd Never Misses A Shot, 38, was sentenced to 36 months in prison to be followed by three years of supervised release.  Never Misses A Shot was indicted by a federal grand jury on April 4, 2012, for making a false statement.  On Oct. 1, 2011, Michael Never Misses A Shot was an inmate in the Codington County Jail.  Aware of the federal investigation into the disappearance of AJ Lufkins, in the Sisseton area, Never Misses A Shot told an FBI Agent that two individuals had confessed to killing AJ Lufkins and disposing of his body. He specifically told the agent the two individuals told him that they had beaten and killed AJ Lufkins. Never Misses A Shot later admitted that he had lied in an attempt to avert attention from another person the FBI Agent had recently interviewed.  He pled guilty to the charge on June 4, 2012.
