White Mountain Apache Man Sentenced to 105 Months in Federal Prison for Arson and Assault with a Dangerous Weapon (U.S. Attorney for the District of Arizona)

U.S. Attorney Dennis K. Burke announced on Sept. 3, 2010, that Lindbert Johnson, Jr., 45, of Whiteriver, Ariz., was sentenced by U.S. District Judge Frederick J. Martone to 105 months in federal prison for arson and assault with a dangerous weapon.  These offenses occurred on the Ft. Apache Indian Reservation in Whiteriver.  On Jan. 28, 2009, Johnson lured another man out of a house and stabbed him with a knife in a completely unprovoked attack.  The victim sustained serious bodily injury as a result of the stabbing.  Then on Sept, 4, 2009, Johnson burned down a residence in Whiteriver over an ongoing dispute regarding ownership of the house.

North Dakota Man Pleads Guilty to Bar Burglary (U.S. Attorney for the District of North Dakota) U.S. Attorney Timothy Q. Purdon announced that on Sept. 2, 2010, Jeremy D. Will, 23, of Fort Rice, N.D., pleaded guilty before U.S. District Court Judge Patrick A. Conmy to a charge of burglary.  On May 19, 2010, around 4:30 a.m., Will entered the T Bar 3 near Cannon Ball, N.D., by prying open the entry door with crow bars. Will stole liquor, a television, money and other items from inside the building.

Nine Plead Guilty to Meth Dealing on the Navajo Nation (U.S. Attorney for the District of Arizona) U.S. Attorney Dennis K. Burke announced on Sept. 1, 2010, that nine people have pleaded guilty in federal court to dealing methamphetamine on the Navajo Nation.  The nine were part of a network of 22 people arrested earlier this year in a coordinated federal-tribal undercover operation for their roles in supplying the Tuba City area with methamphetamine.  In a year-long intensive undercover operation led by the Navajo Nation Drug and Gang Unit with federal and local agency support, police targeted people with a history of dealing methamphetamine in Tuba City, Ariz.  Following this undercover operation, in April 2010 police arrested 22 people on federal charges, nine of whom have now pleaded guilty and await sentencing.   The remaining 13 defendants are pending trial.

Convicted Felon Sentenced for Illegal Possession of Firearm (U.S. attorney for the District of Arizona) U.S. Attorney Dennis K. Burke announced on Sept. 2, 2010, that Delwyn Aaron Randall, 26, of Cove, Ariz., was sentenced by U.S. District Judge Neil V. Wake to 33 months in prison followed by three years of supervised release.  Randall pleaded guilty on March 24, 2010 to one count of being a felon in possession of a firearm.   On Jan. 23, 2009, the defendant, who in 2004 had previously been convicted in New Mexico state court of conspiring to distribute marijuana, possessed a revolver outside his home in Cove.  This led to an eight-hour standoff with police officers of the Navajo Nation which ultimately ended peacefully.

Idaho Man Sentenced to 27 Months for Failure to Register as a Sex Offender (U.S. Attorney for the District of Idaho) U.S. Attorney Wendy J. Olson announced on Sept. 1, 2010, that Jeremy Bohlman, 31, of Plummer, Idaho, was sentenced to 27 months in federal prison for failure to register as a sex offender.  U.S. District Judge Edward J. Lodge also ordered Bohlman to serve five years of supervised release following his prison term.  Bohlman pleaded guilty to the charge in June 2010. In January 2007, Bohlman was sentenced to 50 months in federal prison, followed by three years supervised release for sexually abusing a minor on the Coeur d'Alene Indian Reservation.  During sentencing, Judge Lodge advised Bohlman that he was required to register as a sex offender.  Following his release from prison, Bohlman was required by U.S. Probation and Pretrial Services to reside at the Port of Hope treatment facility in Coeur d’Alene, Idaho.  He registered as a sex offender while at the facility.  On March 23, 2010, Bohlman left the Port of Hope without permission and failed to report his change of address as required by law.  On April 21, 2010, Bohlman was arrested near Fairfield, Washington, after leading authorities on a high-speed car chase beginning in Idaho.

South Dakota Man Pleads Guilty to Larceny (U.S. Attorney’s Office for the District of South Dakota) U.S. Attorney Brendan V. Johnson announced that Frank Holy Rock, age 20, of Manderson, S.D., appeared before U.S. District Judge Jeffrey L. Viken on Aug. 31, 2010, and pleaded guilty to an indictment that charged him with larceny.  Holy Rock broke into the Oglala Sioux Tribe Child Care Program through a bathroom window.  While inside, he stole computer and electronic equipment with a value greater than $1,000 which belonged to the Oglala Sioux Tribe.

Roy Fighting Bear Jr. Pleads Guilty in U.S. Federal Court (U.S. Attorney for the District of Montana) U.S. Attorney Michael W. Cotter announced that during a federal court session in Billings, Mont., on Sept. 1, 2010, before Senior U.S. District Judge Jack D. Shanstrom, Roy Fighting Bear Jr., a 43-year-old resident of Lame Deer, Mont., pleaded guilty to assault resulting in serious bodily injury.  In an offer of proof filed, the government stated it would have proved at trial that on April 14, 2010, Fighting Bear and his common-law wife were drinking alcohol in Lame Deer, which is within the exterior boundaries of the Northern Cheyenne Indian Reservation.  Fighting Bear then beat his wife and left her covered in blood lying behind a shed.

Woman Sentenced for Selling Methamphetamine on Coeur d’Alene Indian Reservation (U.S. Attorney for the District of Idaho)

Jackie Moffitt, aka. Jackie Allen, 44, of Worley, Idaho, was sentenced on Aug. 31, 2010, after pleading guilty to conspiracy to possess with intent to distribute and distribution of methamphetamine. In June 2010, Moffitt admitted to buying and selling methamphetamine on the Coeur d’Alene Indian Reservation. Moffitt also admitted to transporting approximately two pounds of methamphetamine from the Tri-Cities area.

U.S. District Judge Edward J. Lodge sentenced Moffitt to 60 months in the custody of the Federal Bureau of Prisons. The prison sentence will be followed by four years of supervised release where she will be monitored by the U.S. Probation and Pretrial Services.

South Dakota Man Sentenced for Failure to Register as a Sex Offender (U.S. Attorney for the District of South Dakota) U.S. Attorney Brendan V. Johnson announced that Leroy Fewtails, age 34, of Rapid City, S.D., appeared before U.S. District Judge Jeffrey L. Viken on Aug. 30, 2010, and pleaded guilty to an indictment that charged him with failure to register as a sex offender.  Fewtails failed to update his sex offender registration with the Rapid City Police Department as required by federal law.  Fewtails is a sex offender as defined by the Sex Offender Registration and Notification Act (SORNA) since he was convicted in 2001.

Minnesota Man Indicted for Attempted Murder (U.S. Attorney for the District of Minnesota) U.S. Attorney B. Todd Jones announced on Aug. 26, 2010, that a federal superseding indictment unsealed in the District of Minnesota alleges that a second Red Lake, Minn., man was involved in the May 23, 2010, stabbing of another man at a graduation party on the Red Lake Indian Reservation in northwestern Minnesota. The indictment charges Justin James Lussier, age 21, with one count of assault with intent to commit murder, one count of assault with a dangerous weapon and one count of aggravated assault.  Co-defendant Solomon Francis Desjarlait, age 22, was charged on June 15, 2010, with the same three crimes.  The superseding indictment alleges that on May 23, the defendants assaulted another man with a knife, intending to murder him.

North Dakota Woman Sentenced for Burglary and Larceny Charges (U.S. Attorney for the District of North Dakota) U.S. Attorney Timothy Q. Purdon announced that on Aug. 31, 2010, Courtney Charbonneau, 21, of Rolla, N.D., was sentenced before U.S. District Court Judge Daniel L. Hovland for two counts of burglary and two counts of larceny.  Charbonneau pleaded guilty to the charges on May 3, 2010.  Judge Hovland sentenced Charbonneau to one year and three months in federal prison, to be followed by three years of supervised release. Charbonneau was ordered to pay $400 in special assessments to the Crime Victim’s Fund and restitution of $13,290.  On April 3, 2009, Charbonneau and two juveniles broke into a residence in the Belcourt, N.D., area and took money, a PlayStation and keys to a car, using the keys to steal a car parked outside the residence. The car was used to ram into the walls of a bar also in the Belcourt area. Once inside the bar, Charbonneau and the juveniles took alcohol, tills and black lights. After leaving the bar, Charbonneau and the juveniles stole another car parked in the bar parking lot.

South Dakota Man Sentenced for Failure to Register as a Sex Offender (U.S. Attorney for the District of South Dakota) U.S. Attorney Brendan V. Johnson announced that a St. Francis, S.D., man charged with failure to register as a sex offender was sentenced on Aug. 30, 2010, by U.S. District Judge Roberto A. Lange.  Ivan Paul Spotted Calf, age 50, was sentenced to 18 months in prison, five years of supervised release and a $100 special assessment.  Spotted Calf was indicted for failure to register as a sex offender by a federal grand jury on April 13, 2010.  Spotted Calf was required to register as a sex offender in the location he was living based upon a sex offense that he was previously convicted of in federal court.  The charge stems from Spotted Calf failing to register in Todd County between April and September 2009.  He pleaded guilty to the charge on June 8, 2010.

North Dakota Man Pleads Guilty to Assault (U.S. Attorney for the District of North Dakota) U.S. Attorney Timothy Q. Purdon announced that on Aug. 30, 2010, Joseph Great Walker, 20, of Dunseith, N.D., pleaded guilty before U.S. District Court Judge Daniel L. Hovland to a charge of assault resulting in serious bodily injury.  Sometime between March 14 and 15, 2009, Great Walker attacked and assaulted a man who was walking in the St. Mary’s housing area near Dunseith.  Following the assault, the victim was taken to the hospital where he underwent surgery for a fractured leg.

South Dakota Man Pleads Guilty to Sexual Abuse of a Minor (U.S. Attorney for the District of South Dakota) U.S. Attorney Brendan V. Johnson announced that Allen Good Shield, age 20, of Rosebud, S.D., appeared before U.S. District Judge Roberto A. Lange on Aug. 30, 2010, and pleaded guilty to count II of the indictment that charged him with sexual abuse of a minor.  The charge relates to Good Shield knowingly causing a minor under the age of 16 to engage in sexual acts with him between July 2008 and July 2009 in Todd County, S.D.

Wilbur Lee Cadotte Sentenced in U.S. District Court (U.S. Attorney’s Office for the District of Montana) U.S. Attorney Michael W. Cotter announced that during a federal court session in Great Falls, on Aug. 27, 2010, before U.S. District Judge Sam E. Haddon, Wilbur Lee Cadotte, a 54-year-old resident of Seville, Mont., was sentenced to 63 months in prison.  Cadotte was sentenced in connection with his guilty plea to conspiracy to possess with the intent to distribute methamphetamine in a public housing facility.  Tammy Lynn Cadotte was sentenced to 20 months in prison in connection with her guilty plea to misprision of a felony.  In an offer of proof, the government stated it would have proved that on March 23, and March 25, 2009, a confidential informant of the Blackfeet Safe Trails Drug Task Force performed controlled purchases of methamphetamine from Wilbur Cadotte.  The purchases occurred at the Cadottes’ residence located in Seville, Mont., which is on the Blackfeet Indian Reservation.

Minnesota Man Indicted for Assaulting Woman (U.S. Attorney for the District of Minnesota) U.S. Attorney B. Todd Jones announced on Aug. 26, 2010, that a 29-year-old Red Lake man, Minn., was recently indicted in federal court in the District of Minnesota for allegedly assaulting a woman on two occasions, causing her a broken nose and a broken wrist.  The indictment, filed last week in U.S. District Court, charges Orville Dean White

Jr., a member of the Red Lake Band of Chippewa, with two counts of assault resulting in serious bodily injury.  The indictment alleges that on May 1, 2010, White assaulted a female resident of the Red Lake Indian Reservation, breaking her nose. Then, on Feb. 22, 2009, he allegedly broke the woman’s wrist.

Connie Ann Solis Sentenced in U.S. District Court (U.S. Attorney for the District of Montana) U.S. Attorney Michael W. Cotter announced that during a federal court session in Billings, Mont., on Aug. 26, 2010, before Chief U.S. District Judge Richard F. Cebull, Connie Ann Solis, a 44-year-old resident of the state of Washington, was sentenced to 46 months in prison.  Solis was sentenced in connection with her guilty plea to conspiracy to distribute methamphetamine as part of a tribal drug operation, “Junkyard Dog.”

Brian Lee Blackwolf Sentenced in U.S. District Court (U.S. Attorney for the District of Montana) U.S. Attorney Michael W. Cotter announced that during a federal court session in Billings, Mont., on Aug. 26, 2010, before Chief U.S. District Judge Richard F. Cebull, Brian Lee Blackwolf, a 29-year-old resident of Lame Deer, Mont., was sentenced to 30 months in prison.  Blackwolf was sentenced in connection with his guilty plea to sexual abuse of a minor.

Randall Langdon Black Eagle Pleads Guilty in U.S. Federal Court (U.S. Attorney for the District of Montana) U.S. Attorney Michael W. Cotter announced that during a federal court session in Billings, Mont., on Aug. 25, 2010, before Senior U.S. District Judge Jack D. Shanstrom, Randall Langdon Black Eagle, a 35-year-old resident of Crow Agency, Mont., pleaded guilty to assault resulting in serious bodily injury.  In an offer of proof, the government stated it would have proved at trial that in the early morning hours of Dec. 31, 2009, Bureau of Indian Affairs law enforcement received a call that there was a domestic violence incident at the home of Black Eagle and the victim.  When law enforcement arrived at the residence, the victim was bloody and stated that Black Eagle had assaulted her.  Both the victim and Black Eagle had been drinking.
